The situation

Patricia, 41, is a California licensed real estate broker in San Diego. She represented a buyer in the 2021 purchase of a La Jolla condominium. Post-closing, the buyer discovered a persistent mold issue in the master bathroom. The buyer filed a DRE complaint alleging Patricia knew about the mold problem (from her walkthrough) and failed to disclose it. DRE conducted an 18-month investigation and in February 2026 mailed Patricia a formal Accusation, Misrepresentation / Fraud (Business & Professions Code §10177(b)), Negligent misrepresentation of property condition (failure to disclose known mold defect).

The Accusation was mailed February 14, 2026. Patricia received it February 18. Her Notice of Defense deadline is February 29 (15 days from mailing date February 14). Patricia has 11 days from receipt to respond.

(a) The 15-day deadline runs from the MAILING DATE, February 14, not February 18 when she received it. This distinction causes many licensees to miss the deadline. Patricia has until February 29, not March 4 as she might calculate from receipt.

(b) The Notice of Defense is not an admission or a defense statement. Under Government Code §11506, the Notice of Defense is simply a written statement that Patricia requests a hearing and denies the Accusation. Filing a Notice of Defense preserves ALL defenses. Patricia should NOT try to explain her side in the Notice of Defense, doing so can inadvertently make admissions. The Notice of Defense should be a simple, clean filing.

(c) DRE must prove misrepresentation by clear and convincing evidence. Patricia conducted the walkthrough. She did not observe mold in the master bathroom during her walkthrough, the mold was behind a closed bathroom vanity that was not opened during the inspection. Patricia can document that: (a) her walkthrough notes do not show mold observation; (b) the Transfer Disclosure Statement was completed accurately based on what was observable; (c) the structural inspection report (ordered by the buyer) did not flag the bathroom mold issue. This is a strong defense to the "knew and failed to disclose" standard DRE must prove.

(d) Patricia's license is her entire livelihood. Without it, she cannot represent buyers or sellers, cannot collect commissions, and must transfer her clients to another broker. A Default (if she misses the deadline) ends her career immediately, without any opportunity to defend herself.

Why the agency will not advise you

DRE cannot advise licensees on contesting its own Accusations. OAH provides no licensee defense strategy. Six known incumbent attorney firms (dredefenselawyer.com, Century Law Group, Seth Weinstein Law, Unlock Legal, Ray & Bishop, Guiding Legal Counsel) confirm market viability but all charge $5,000–$15,000 retainer. The 15-day mailing-date deadline (same critical trap as CA CDI insurance) creates extreme time pressure, most agents learn about it only after receiving the Accusation.
