Los Angeles Home-Sharing Ordinance NOV and ACE Hearing Defense
The situation
Sofia, 37, lives in her Silver Lake bungalow in Los Angeles. She's been hosting an Airbnb in her downstairs in-law suite since 2022, earning $28,000/year to help cover her mortgage. She registered with LAHD in 2022 and has a Home-Sharing Registration Certificate.
In February 2026, Sofia received a Notice of Violation (NOV) from LAHD: "Un-hosted Stay: 141 Days, violation of 120-day annual cap under LAMC § 12.22 A.23(3)(b)". Proposed fine: $2,000/day × 21 excess days = $42,000.
Sofia is certain she was home (present) during most of those stays. She rents the in-law suite while living upstairs in the main house, she's almost always home. But Airbnb's data feed to LAHD showed 141 "bookings" without distinguishing hosted from un-hosted nights.
(a) The 120-day cap ONLY applies to un-hosted stays. If Sofia was present in the home during a booking, those nights are "hosted stays" and don't count toward the 120-day cap. LAHD's enforcement system uses Airbnb platform data that doesn't automatically distinguish hosted from un-hosted. Sofia may be able to contest the entire citation by proving that 70+ of the 141 nights she was present in the home (utility bills at the address, neighbors' declarations, her own reservation records).
(b) She has 10 days to respond. The NOV requires a written response within 10 days or the fine becomes final and collectable. LAHD will schedule an ACE administrative hearing if Sofia requests one in her response.
(c) The ACE hearing is self-representable. The LAHD Hearing Officer hears ACE cases. Sofia can appear in person (or Zoom since 2023) with documentation. No attorney required. But she needs to know what documentation to bring: reservation history from Airbnb's host dashboard, her CalFresh/voter registration showing her primary address, a neighbor declaration that she was present, and credit card statements showing expenses at the Silver Lake address during the disputed period.
Who receives this
Los Angeles Airbnb/VRBO hosts who receive LAHD Notices of Violation or certificate revocation notices under the Home-Sharing Ordinance. Primary segments: (1) LA homeowners hosting in-law suites, spare bedrooms, or ADUs while living in the main house (hosted-stay misclassification is the most common defensible citation); (2) LA hosts who received certificates but have certificate renewal issues (LAHD processing delays); (3) LA Airbnb hosts who recently moved and need to update primary residence records.
Why the agency will not advise you
LAHD cannot advise hosts on how to contest NOVs it issued. LAHD's Home-Sharing Records Portal handles permit registration, not enforcement defense. Airbnb provides no legal guidance to hosts who receive LAHD enforcement letters. RentPermit.com covers permit tracking and application, not NOV response.
