The situation

A small freight broker's surety company notifies FMCSA that a cargo-claim payout dropped their $75,000 bond below the required threshold. FMCSA sends a suspension notice with a 7-calendar-day clock. The broker doesn't know exactly what "written evidence" FMCSA needs to see, whether their surety has already confirmed the restoration on FMCSA's end, or how to move fast enough, and every day of suspension means they legally cannot book a single load, an existential threat to a small brokerage's cash flow and shipper relationships.

Small freight brokers and freight forwarders (BMC-84/BMC-85 holders) that receive an FMCSA financial-security shortfall or suspension notice under the rule that took effect January 16, 2026.

Why the agency will not advise you

FMCSA issues the suspension but doesn't help the broker assemble the evidence to lift it; sureties and trust institutions sell the bond product but don't help with the response paperwork once a claim has already drawn the balance down, nobody in the existing ecosystem is positioned to help at the moment of crisis.
