Pet Insurance Claim Denial Appeal
The situation
A pet owner's claim for their dog's TPLO surgery ($6,500) or their cat's hyperthyroidism treatment ($3,200) is denied by their pet insurer. The denial letter cites "pre-existing condition" based on a vet note from two years ago that mentioned the pet was "limping", but the owner knows that limping episode was a sprained paw, unrelated to the cruciate ligament rupture now requiring surgery. The insurer's Explanation of Benefits (EOB) letter provides a denial reason but no appeal guidance. The owner has 30 days to appeal (most policies) but doesn't know what to cite in the appeal, which policy provisions are relevant, or that filing a state DOI complaint simultaneously creates regulatory pressure.
Who receives this
US pet insurance policyholders with denied claims above $500, primarily owners of dogs and cats with denied claims for orthopedic conditions (TPLO surgery, hip dysplasia, frequently denied as hereditary/pre-existing), dental disease (most policies exclude periodontal disease; policyholders dispute whether a specific dental procedure is "dental illness" vs. "dental accident"), cancer treatment (long course chemotherapy claims where insurer disputes whether cancer was pre-existing), and dermatology/allergy conditions (chronic allergy cases where insurer claims prior vet notes document pre-existing signs). Trupanion, ASPCA, Lemonade Pet, and Embrace are the most-complained-about carriers in state DOI databases.
Why the agency will not advise you
The insurer's claims adjuster cannot advise the policyholder on how to dispute the insurer's own denial, a hard structural constraint. Attorney services exist (Florida pet insurance claim lawyers) but charge contingency fees or hourly rates that make small claims uneconomical. Embrace's help center tells policyholders to appeal but provides no appeal letter assistance, that is the insurer guiding policyholders to use the insurer's appeal process with no help on building the case. The tool fills exactly the gap between "you can appeal" and "here's the complete appeal package."
Key facts, with sources
- Pet insurance carriers deny approximately 5% of submitted claims in the US market, primarily for pre-existing condition exclusions and policy-specific exclusions (breed-specific conditions, hereditary conditions, elective procedures). The US pet insurance market exceeded 5 million insured pets in 2024, growing at 20%+ CAGR, with premium values ranging from $10.7B to $15.8B depending on the methodology. At a 5% denial rate, approximately 250,000+ pet insurance claims are denied annually in the US. - Pet insurance is regulated under state insurance codes in all US states, and state Departments of Insurance (DOI) accept complaints against pet insurance carriers for wrongful claim denials, misrepresentation of policy terms, and unfair claims settlement practices under the NAIC Unfair Claims Settlement Practices Act (UCSPA) model legislation. However, state DOI complaint portals are generic and do not provide pet-insurance-specific appeal guidance or document generation assistance. When to bring in a professional
Self-serve responses fit routine cases: clear facts, amounts a business can absorb, and a deadline still ahead of you. Bring in a licensed professional when the amount at stake is large relative to their fee, the facts are genuinely disputed, criminal exposure is possible, or the deadline has already passed. A short paid consultation to sanity-check your plan is often worth it even when you handle the filing yourself.
