SBA 8(a) Business Development Program Termination Response and OHA Appeal
The situation
Precision Federal Solutions LLC is a 12-person 8(a)-certified government IT services firm in Northern Virginia. Their 8(a) sole-source contracts represent $2.3 million of their $3.1 million annual revenue. In March 2026 they received a certified letter from SBA's Office of Business Development:
"Letter of Intent to Terminate 8(a) Business Development Program Participation, Grounds: Failure to provide financial data in response to December 2025 Annual Review Data Call."
Their principal owner, Denise, had delegated the SBA data call response to her office manager who had retired in November 2025. The data call was missed. They didn't even know.
(a) 30 days to send a written response to SBA AA/BD explaining why they should not be terminated. The termination ground (failure to provide financial data) is curable, they CAN provide the data now. But the response needs to be structured correctly: acknowledge the failure, provide all requested data, and demonstrate that the failure was not willful and that the firm remains otherwise eligible.
(b) She simultaneously needs to evaluate the 45-day OHA appeal option. The OHA appeal is a separate track, if SBA responds to the 30-day letter with a Notice of Termination, Denise has 45 more days from that notice. But she can file the OHA appeal AND submit the AA/BD response simultaneously, keeping all options open.
(c) Losing 8(a) status means losing $2.3 million in sole-source contracts. When the 8(a) term ends (either by termination or graduation), the firm can no longer receive 8(a) sole-source awards. For Precision Federal Solutions, this means immediate loss of their two largest contracts.
(d) Government contracts attorneys quoted $10,000–$25,000 for full representation. That's 3–8% of annual revenue for a firm in crisis. Denise needs a structured response she can prepare herself and pay for attorney review of the final draft.

Why the agency will not advise you
SBA's AA/BD office cannot advise 8(a) participants on how to contest its own termination determination. SBA's appeals.sba.gov platform accepts appeal filings but does not explain how to draft them. Law firms fill the gap at $10,000–$40,000. EZ8A provides human advisory services, not self-serve tools. The 628 current termination targets create an immediate, time-sensitive market that no automated tool has claimed.

- When an 8(a) participant receives a Letter of Intent to Terminate from SBA's Associate Administrator for Business Development (AA/BD), it has 30 days from the date of receipt to submit a written response to SBA explaining why the proposed grounds do not justify termination (13 CFR § 124.303(d)). If SBA then issues a Notice of Termination, the participant has 45 calendar days from receipt to appeal to OHA (13 CFR § 134.209). OHA has jurisdiction over early graduation and termination appeals.
