New Construction Builder Warranty Defect Formal Notice
The situation
Marcus, 34, and Priya, 32, bought a new DR Horton home in Houston in September 2025 for $342,000. In August 2026, their 11th month, their home inspector finds 23 defects: improper HVAC ductwork causing airflow imbalance, stair railing wobble, three doors that don't close flush, drywall cracking at ceiling corners in three rooms, missing caulk at multiple window frames, and grading issues near the back fence causing water pooling.
Their DR Horton warranty portal gives them a text box to type in their issues. They type up the list and submit it online. DR Horton's customer service rep responds: "We'll schedule a warranty review visit in 4-6 weeks."
The 1-year workmanship warranty expires in September 2026, 4-5 weeks away.
(a) Their online portal submission may not constitute formal "written notice" under Texas Property Code Chapter 27, which requires a formal written notice at least 60 days before filing suit. If DR Horton denies their warranty claims, they may have waived their right to sue because they didn't submit a proper notice.
(b) The HVAC ductwork issue may be a 2-year systems defect, not just a 1-year workmanship issue, extending their window IF they formally classify it correctly.
(c) A certified mail Notice of Warranty Defect citing Chapter 27 and their specific DR Horton warranty provisions creates an evidentiary record that: (a) proves the defects were reported before the warranty expired, (b) triggers DR Horton's contractual obligation to respond in writing, (c) starts the clock on the builder's repair timeline, and (d) preserves their litigation rights if DR Horton denies the claim.
(d) DR Horton's warranty department cannot advise Marcus and Priya on any of this, they are trained to route issues through the repair portal, not to advise homeowners on how to formalize claims that create legal liability.
Who receives this
New construction homeowners in their first 12 months of ownership who have received an 11-month inspection report or discovered defects approaching warranty expiration. Primary builders: DR Horton (~90k homes/year), Lennar (~70k), PulteGroup (~30k), NVR/Ryan Homes (~21k), Toll Brothers (~10k), Taylor Morrison, Meritage, KB Home. Geographic concentration: TX (no state income tax draws builders), FL, AZ, GA, NC, SC, TN, Sunbelt high-growth markets.
Why the agency will not advise you
Builder warranty departments cannot advise homeowners on how to create legal records that preserve litigation rights against the builder. Professional 11-month home inspectors document defects but don't generate formal legal notices. Construction attorneys charge $3k-$8k, economically irrational for $5k-$30k in repair demands. The $300-$500 professional 11-month inspection + the $49 formal notice letter = complete solution for <$600.
Key facts, with sources
- Over 85% of new construction homes have at least one defect identified during a professional 11-month warranty inspection. An 11-month inspection is performed before the builder's 1-year workmanship warranty expires. Common defects: incomplete or improperly applied caulking and weatherstripping, HVAC ductwork issues, door and window alignment, grading/drainage issues, drywall imperfections, electrical switch/outlet issues, plumbing pressure and seal issues. The critical legal point: builders are contractually obligated to repair defects ONLY when the homeowner provides formal written notice. Verbal or online portal reports may not preserve legal rights if the builder denies receiving notice. - State right-to-repair laws govern builder defect claims and contain specific notice requirements. California SB 800 (Civil Code § 895-945.5) requires the homeowner to provide the builder with a 'Notice of Claim' before filing suit, the builder then has 14 days to acknowledge and 30 days to inspect. Texas Property Code Chapter 27 requires a written notice at least 60 days before filing suit, with the builder given the opportunity to inspect and repair. Florida Statute § 558 requires written notice 60 days before suit (120 days for associations). These statutes toll the statute of limitations during the notice-and-cure process, making the formal written notice both a repair demand AND a litigation preservation mechanism. - New construction home sales remain at elevated levels in the US: approximately 600k-700k new homes sold per year in 2024-2026 as builders filled the gap left by low existing home inventory. The largest publicly traded builders, DR Horton (the largest US homebuilder), Lennar, PulteGroup, NVR, Toll Brothers, Taylor Morrison, Meritage, KB Home, each sell 10k-90k homes per year. Each of these builders has an online warranty portal where homeowners submit warranty requests. None of these builder portals generate formal certified-mail notices that cite specific warranty provisions or preserve litigation rights. Builder customer service teams are trained to route issues through the repair portal, not to advise homeowners on the formal notice process that maximizes legal protection. When to bring in a professional
Self-serve responses fit routine cases: clear facts, amounts a business can absorb, and a deadline still ahead of you. Bring in a licensed professional when the amount at stake is large relative to their fee, the facts are genuinely disputed, criminal exposure is possible, or the deadline has already passed. A short paid consultation to sanity-check your plan is often worth it even when you handle the filing yourself.
